Consumer Health Data Privacy Policy

This Policy explains how The Unique Dating Company LLC collects, uses, discloses, and protects Consumer Health Data in connection with Abby / My AI Matchmaker. It supplements the main Privacy Policy.

1. What Consumer Health Data Means

“Consumer Health Data” means Personal Information that is linked or reasonably linkable to a consumer and identifies or may be used to infer a consumer’s past, present, or future physical or mental health status, as defined by applicable consumer-health privacy law. Information used for compatibility or relationship analysis may fall within this definition when it reveals or permits inferences about health or wellness.

Consumer Health Data may be protected even when it is not maintained by a healthcare provider and is not subject to the Health Insurance Portability and Accountability Act. The meaning of Consumer Health Data varies by jurisdiction, and this Policy is intended to apply to information covered by an applicable consumer-health privacy law.

2. Categories We May Collect

  • mental or emotional wellbeing information voluntarily shared in questionnaire answers, conversations, coaching, support, or post-date debriefs;
  • physical-health conditions, disabilities, medications, treatment, or health preferences voluntarily shared by a user;
  • sexual health, sex life, sexual orientation, reproductive information, or intimate relationship information voluntarily shared for matchmaking or compatibility;
  • information about health-related accommodations or safety needs;
  • location information that may reveal a visit to a health-related location when a location feature is used; and
  • inferences derived from the above information for compatibility, personalization, or requested service features.

Except where a specific safety or accessibility feature reasonably requires the information, providing Consumer Health Data is optional. Users may skip health-related questions without losing access to unrelated Service features.

We will not request a diagnosis, medication, treatment history, reproductive information, or sexual-health information unless it is reasonably relevant to a clearly identified user-requested feature, safety function, accommodation, or support request.

3. Sources

We collect Consumer Health Data directly from you through profile fields, questionnaires, conversations with Abby, support interactions, post-date debriefs, uploaded content, and other voluntary submissions. We may derive limited inferences from information you provide and your interactions with the Service. We do not purchase Consumer Health Data from data brokers.

We do not obtain Consumer Health Data from another user or third party for use in your profile or compatibility analysis unless you direct the disclosure, the source has authority to provide it, or another lawful basis applies.

4. Purposes

  • provide compatibility analysis, matchmaking, profile insights, coaching, and features you request;
  • personalize questions, recommendations, and support;
  • support safety, abuse prevention, fraud detection, and user reports;
  • respond to support requests and exercise privacy rights;
  • maintain, troubleshoot, and improve requested features using aggregated or de-identified information; and
  • comply with law and protect rights and safety.

We do not use Consumer Health Data to make employment, insurance, housing, credit, lending, or other eligibility decisions about you, and we do not use it to train general-purpose artificial-intelligence models.

We do not use geofences around healthcare facilities or other health-service locations to identify, track, collect information from, or send messages to a consumer concerning Consumer Health Data.

When we treat Consumer Health Data as de-identified, we take reasonable measures designed to prevent association with a person or household, maintain the information in de-identified form, and contractually prohibit recipients from attempting to re-identify it except as permitted to test de-identification controls.

We will not use Consumer Health Data for a materially different purpose without additional notice and consent when required.

5. Disclosures

We may disclose Consumer Health Data only as reasonably necessary for the purposes above to service providers acting on our behalf, such as cloud hosting, customer support, security, fraud prevention, and contracted artificial-intelligence processors. Categories of service providers are also described in Privacy Policy Section 5.

Access to Consumer Health Data is limited to authorized personnel and service providers that need the information for the disclosed purpose and are subject to confidentiality, data-protection, security, retention, and deletion obligations.

Our agreements with processors are intended to limit processing to documented instructions, prohibit independent use, require safeguards appropriate to the information, and require deletion or return when processing ends, subject to applicable law.

We may disclose Consumer Health Data when you direct or consent; when required by valid legal process; or when reasonably necessary to protect users, investigate fraud or exploitation, or respond to an emergency involving risk of death or serious physical harm.

Specific affiliates with whom Consumer Health Data is shared: none at this time.

If an affiliate begins receiving Consumer Health Data, we will update this Policy before the disclosure and obtain consent where required.

No Sale: We do not sell Consumer Health Data. We do not use or disclose Consumer Health Data for third-party cross-context behavioral advertising.

We do not process Consumer Health Data for targeted advertising.

7. Your Rights

  • confirm whether we collect, use, or disclose your Consumer Health Data;
  • access Consumer Health Data, including a list of categories or specific information where required;
  • withdraw consent for future collection or sharing;
  • request deletion, including from service providers where required; and
  • appeal a denied request where applicable law provides an appeal right.

Submit a request to legal@uniquedatingcompany.com with the subject “Consumer Health Data Request.” We may verify your identity and authority before acting on a request.

When we approve a deletion request, we will notify processors holding the relevant Consumer Health Data and direct them to delete it where required, unless an exception applies. Information in archived or backup systems will be isolated from ordinary use and deleted through the applicable rotation process.

If we deny a request, our response will explain the basis for the denial and, where applicable, provide instructions for submitting an appeal.

8. Retention and Security

We retain Consumer Health Data only as long as reasonably necessary for the purpose for which it was collected, requested Service functionality, safety and fraud prevention, legal compliance, dispute resolution, and enforceable recordkeeping. We use safeguards appropriate to the sensitivity of the information.

We maintain category-based retention criteria for Consumer Health Data and periodically review whether continued retention is necessary. A legal hold or fraud-prevention exception will be limited to information relevant to the documented purpose and will not authorize unrelated use.

Access should be limited according to role and business need. Consumer Health Data should not be included in development, testing, or analytics environments unless the information is appropriately protected, minimized, or de-identified.

9. Changes and Contact

We will update this Policy before collecting new categories or using Consumer Health Data for materially different purposes and will obtain additional consent when required.
